INTRODUCTION
Our
Acceptable
Use
Policy
("AUP")
is
intended
to
help
enhance
the
use
of
the
Internet
by
preventing
unacceptable
use.
All
users
of
of
our
Internet
services
(the
"Services")-those
who
access
some
of
our
Services
but
do
not
have
accounts
("Visitors"),
as
well
as
those
who
pay
a
monthly
service
fee
or
have
subscribed
for
free
the
Services
("Members")-must
comply
with
this
AUP.
We
support
the
free
flow
of
information
and
ideas
over
the
Internet
and
do
not
actively
monitor
use
of
the
Services
under
normal
circumstances.
Similarly,
we
do
not
exercise
editorial
control
over
the
content
of
any
Web
site,
electronic
mail
transmission,
news
group,
or
other
material
created
or
accessible
over
or
through
the
Services,
except
for
certain
proprietary
websites.
However,
in
accordance
with
our
Internet
Service
Agreement,
we
may
remove
any
materials
that,
in
our
sole
discretion,
may
be
illegal,
may
subject
us
to
liability,
or
which
may
violate
this
AUP.
We
may
cooperate
with
legal
authorities
and/or
third
parties
in
the
investigation
of
any
suspected
or
alleged
crime
or
civil
wrong.
Your
violation
of
this
AUP
may
result
in
the
suspension
or
termination
of
either
your
access
to
the
Services
and/or
your
account
or
other
actions
as
detailed
in
Section
3.
This
AUP
should
be
read
in
conjunction
with
our
Privacy
Policy
Statement
and
other
policies.
2.
RULES
&
TERMS
OF
OUR
ACCEPTABLE
USAGE
POLICY
- You
will
be
responsible
for
the
content
of
your
website,
including
obtaining
the
legal
permission
for
any
works
they
include
and
ensuring
that
the
contents
of
these
pages
do
not
violate
UK
law.
Copyright
or
trademark
infringement.
or
using
the
Services
to
transmit
any
material
(by
email,
uploading,
posting,
or
otherwise)
that
infringes
any
copyright,
trademark,
patent,
trade
secret,
or
other
proprietary
rights
of
any
third
party,
including,
but
not
limited
to,
the
unauthorized
copying
of
copyrighted
material,
the
digitization
and
distribution
of
photographs
from
magazines,
books,
or
other
copyrighted
sources,
and
the
unauthorized
transmittal
of
copyrighted
software
counts
as
infringement
of
teh
terms
of
use.
Should
any
web
pages
not
conform
to
this
then
they
will
be
removed.
- The
posting
of
illegal
content
waives
any
rights
on
your
part.
At
our
discretion
we
may
inform
any
and
all
relevant
parties
of
your
actions
including
copyright
owners,
police,
civil
or
government
bodies
and
enforcing
or
regulatory
organisations.
In
these
circumstances
we
may
at
our
discretion
reveal
any
and
all
identifying
information
we
have
about
you
to
enable
the
relevant
parties
to
pursue
the
matter.
Users
who
violate
our
terms
of
service
by
posting
material
contrary
to
our
AUP
are
subject
to
the
full
force
of
the
law.
- The
posting
of
spam
or
"Unsolicited
Commercial
Email"
via
newsgroups,
email,
message
boards
or
other
formats
whilst
utilising
our
service
is
strictly
forbidden
and
will
result
in
immediate
termination
of
your
account.
- Login
names
and
passwords
must
be
kept
secret
and
not
communicated
to
any
third
party,
except
for
agencies,
such
as
webpage
designers,
working
on
your
behalf.
We
must
be
notified
immediately
if
they
are
compromised.
If
someone
were
to
gain
access
to
your
account
password,
they
could
tamper
with
files
held
on
your
site,
email
under
your
name,
gain
access
to
personal
information
and
otherwise
cause
disruption.
You
will
be
held
responsibel
for
any
actions
taken
whilst
an
individual
is
logged
into
our
service
utilising
your
username
and
password.
- You
may
use
up
to
a
maximum
of
25Mb
of webspace
(additional
space
is
available
on
written
request).
The
free
space
cannot
be
linked
to
a
Fully
Qualified
Domain
name
unless
purchased
through
our
service.
The
webspace
does
not
have
access
to
a
CGI-BIN
or
access
logs.
Commercial
Web
Space,
without
these
restrictions,
is
available
on
application.
- You
should
maintain
an
index
page
called
"index.htm"
or
"index.html"
in
the
root
directory
of
the
your
space.
No
deep
linking
to
your
site
from
other
sites
is
permitted.
All
links
must
point
directly
to
your
homepage
called
"index.htm"
or
"index.html".
No
serving
of
files,
images,
graphics
or
other
content
from
our
webserver
to
third
party
websites/webservers
are
allowed.
- We
reserve
the
right,
without
notice
or
explanation,
to
remove
material
which
does
not
comply
with
our
acceptable
usage
policy,
such
as
material
of
an
adult
nature,
copyrighted
material
or
pirated
software.
- We
reserve
the
right
to
suspend
any
or
all
of
our
service
at
any
time,
without
prior
notice,
explanation,
or
recompense
this
includes
the
termination
of
webspace
and/or
email.
- Commercial
use
of
your
homepages
space
is
permitted,
however
we
will
be
in
no
way
liable
for
any
loss,
consequential
or
otherwise.
This
is
an
explicit
exemption
to
the
general
Conditions
of
Use
referring
to
selling
on
or
sharing
use
of
the
service.
We
shall
not
be
held
liable
for
any
loss
however
occasioned
as
a
result
of
the
suspension,
removal
or
unavailability
of
a
customer's
homepages
site
or
material
stored
within
it.
- Technical
Support
will
only
be
provided
at
our
discretion
for
uploading,
downloading
and
viewing
pages.
No
support
will
be
provided
for
HTML
authoring
or
page
design,
although
we
may
have
support
pages
providing
help
with
these
topics.
- No
logs
or
any
detail
of
who
visited
your
site
will
be
made
available.
- You
will
be
responsible
for
retaining
copies
of
your
own
data.
We
will
not
keep
backups
of
your
pages.
- We
accept
no
responsibility
for
loss
of
data,
information
in
any
form
or
other
matters
whatsoever
which
result
from
the
use
of
this
service.
- We
reserve
the
right
to
display
advertising
on
your
site
and
will
not
be
liable
to
make
any
payment
to
you
in
relation
to
this.
- You
will
be
held
responsible
for
and
accept
responsibility
for
any
defamatory,
confidential,
secret
or
other
proprietary
material
available
via
your
homepages
site.
- You
must
ensure
that
your
index.html
file
[the
first
to
be
viewed
on
a
site]
does
not
contain
any
material
liable
to
offend.
A
clearly
readable
warning
page
must
be
displayed
before
any
material
of
a
potentially
objectionable
nature
is
displayed,
this
includes
artwork,
language
or
works
of
art
that
could
conceivably
offend.
- If a site
shows
excessive
usage
of
traffic
in
any
one
month,
the
site
will
become
unavailable
until
the
beginning
of
the
next
calendar
month.
We
will
require
sites
that
we
consider
to
show
regularly
excessive
use
to
be
modified
or
be
moved
to
a
different
server.
Excessive
use
shall
be
defined
by
us
at
your
request.
We
reserve
the
right
to
vary
the
definition
of
'excessive
use'
at
their
sole
discretion
at
any
time
without
prior
notice.
- Any
decision
made
by
us
in
relation
to
this
service
shall
be
final.
We
reserve
the
right
to
revise,
amend,
or
modify
this
AUP,
our
Privacy
Policy
and
our
other
policies
and
agreements
at
any
time
and
in
any
manner
without
prior
notice.
It
is
your
obligation
to
regularly
check
the
terms
of
service
laid
out
on
this
webpage
to
ensure
your
website
and
usage
of
our
service
falls
within
our
agreement.
If
you

locate

service

any
time

3.
REPORTING
VIOLATIONS
OF
OUR
AUP
We
request
that
anyone
who
believes
that
there
is
a
violation
of
this
AUP
direct
the
information
to
our
Abuse
Department
at:
abuse@pobox.co.uk
If
available,
please
provide
the
following
information:
- The
IP
address
used
to
commit
the
alleged
violation
- The
date
and
time
of
the
alleged
violation,
including
the
time
zone
or
offset
from
GMT
- Evidence
of
the
alleged
violation
Email
with
full
header
information
provides
all
of
the
above,
as
do
syslog
files.
Other
situations
will
require
different
methods
of
providing
the
above
information.
We
may
take
any
one
or
more
of
the
following
actions
in
response
to
complaints:
- issue
warnings:
written
or
verbal
- suspend
the
Member's
newsgroup
posting
privileges
- suspend
the
Member's
account
- terminate
the
Member's
account
- bill
the
Member
for
administrative
costs
and/or
reactivation
charges
- bring
legal
action
to
enjoin
violations
and/or
to
collect
damages,
if
any,
caused
by
violations.
4.
GOVERNING
LAW
AND
JURISDICTION.
THIS
AGREEMENT
SHALL
BE
GOVERNED
BY
AND
CONSTRUED
IN
ACCORDANCE
WITH
THE
LAW
OF
ENGLAND
AND
WALES
AND
THE
PARTIES
HERETO
SUBMIT
ALL
DISPUTES
TO
THE
EXCLUSIVE
JURISDICTION
OF
THE
COURTS
OF
ENGLAND
AND
WALES.
